Meeting
February 15, 2007

Peg Arguimbau Chairman, Katherine Roth, and Stephen Cremer were the members present.
Stephan Glicken arrived at 8:00 p.m. Hank Langstroth arrived at 8:10 p.m.

7:45 p.m. South Main Street Rezoning Project Update:
Present: Attorney, Bob Shelmerdine, appeared before the Commission to represent Intoccia Corporation.
Steve Campbell and Chris Lucas from Coler and Colantonio Engineering were also present. Attorney, Dick Gelerman,
was present in the audience.
Steve Campbell reviewed the overall proposed plan with the Commission, and identified the following
proposed development parcels on the west side of Old Post Road for the Commission:
All property owned by Mr. Gobbi.
The former Cummings’ property. (Now owned by Mr. Intoccia.)
The Cranberry Bog Area.
Steve Campbell explained to the Commission that Mr. Intoccia proposes to develop a Lifestyle Center/Office Project
on the west-side of Old Post Road abutting Rte. 95/South Main Street.  He is requesting that the Town
vote to change the zoning in that section of the site at the March 12, 2007 Special Town Meeting. Mr. Intoccia
intends to deed the Cranberry Bog area to the Conservation Commission if the proposed zoning amendment is
approved by Town Meeting. Plans for the proposed project also include the construction of an access roadway
within the County Layout of Old Post Road adjacent to the bog area and bordering vegetated wetlands.
Quorum – Stephan Glicken arrived
Stephen Cremer voiced his concern that the close proximity of the proposed access roadway might adversely
affect a portion of the adjacent bog area and bordering vegetated wetlands.
Steve Campbell expressed a willingness to install a retaining wall between the County Layout of Old Post Road
and the bog area for mitigation/erosion control. He explained that since a portion of the bog area encroaches on
the County Layout, the proposed roadway would provide limited access. He agreed to petition Norfolk County
to improve the access roadway within the County Layout in an effort to alleviate the
concerns of the Commission.
Peg requested that in addition to petitioning Norfolk County to improve the access roadway, the developer
needs to find out how long the Morse Bros. have the rights to the vines/ root systems of the onsite
cranberry bogs. She explained that it is necessary to maintain the connection to Ocean Spray once the
cranberry bogs are deeded to the Commission because they would not be able to get back under the umbrella
of the Ocean Spray cooperative, due to the small size of the cranberry bogs.
Attorney, Bob Shelmerdine, stated that as of 7/1/07, the cranberry bogs would belong to Mr. Intoccia.
He agreed to find out more information on the lease of the cranberry bogs and report back to the Commission.
The developer also proposes to donate a parcel of land to the Town for a potential well site. The potential well site
is subject to a Town Meeting Article, because it would be deeded to the Town.  
Mr. Intoccia proposes to comply with Natural Heritage requirements concerning on/off site habitat mitigation
and he is willing to donate a sum of money to acquire some mitigated land elsewhere.
Peg stated that the Commission is still interested in knowing what Mr. Intoccia’s potential development plans
are for his property on the other side of the highway.
Steve Campbell estimates that the amount of water usage for the proposed development project will be
approximately 60,000 GPD. (The water usage design plans are not yet completed).
A combination of impervious/pervious pavement on all non-heavy use areas and walkways is being proposed
in an effort to generate more groundwater recharge for this development project.
The stormwater management policy for the proposed project will be in accordance with the Town’s rules and regulations.
A 60,000-gallon capacity septic system and one on-site wastewater treatment plant is being proposed for this
development project. (A special permit is required by the ZBA for Section 40 Ch. 4,500 Groundwater
Protection District.)

Preliminary investigations indicate that the developer might be able to tap off of the 12” water main pipe that
is connected to the Moose Hill Water Supply Tank for his proposed development project. Another possibility
is to obtain approximately 300 gallons of water from the potential well field.
The developer is interested in a residential component for a future development project that would qualify
for a LIP on the front portion of his property. This would be subject to an Environment Impact Review.
One 75,000-sq. ft., and two 80,000 sq.ft., retail establishments are proposed for this commercial development project.
Attorney Shelmerdine stated that the Commission will receive a copy of the MOU soon with more specific language
concerning the density of the proposed development project.

Stephen Cremer moved to enter into Executive Session to discuss Real Property Acquisition.
Katherine Roth seconded. Voted. Unanimous.

9:35 p.m. Approve Past Meeting Minutes:

Hank moved to accept the February 1, 2007 Meeting Minutes as presented.
Stephen Cremer seconded. Voted. Unanimous. 4-0-0.

9:40 p.m. Other Business:

Katherine Roth presented copies of an e-mail article of a decision made by the N.J. Supreme Court,
where the Court upheld a petition for taking land by eminent domain for the purpose of preserving
open space.
